Terms of service.
Welcome to ArcView ("ArcView", "we", "us", or "our"). These Terms of Service ("Terms") govern the use of our website, arcview.com.pk, and the provision of our creative, design, development, digital marketing, and related services.
By accessing our website, requesting a quotation, approving a proposal, making a payment, or engaging ArcView for services, you acknowledge that you have read, understood, and agreed to these Terms.
1. About ArcView
ArcView is a creative and digital agency providing design, development, branding, marketing, and related digital services to businesses, organizations, and individuals.
Our services may include, but are not limited to:
Graphic Design
Branding and Brand Identity
Logo Design
Brand Guidelines
Print and Promotional Design
UI/UX Design
Website Design and Development
E-commerce Store Development
Web Applications
Mobile App Design and Development
Landing Page Design and Development
Search Engine Optimization (SEO)
Social Media Marketing
Social Media Management
Social Media Content Creation
Social Media Posts and Creative Designs
Reels and Short-form Video Content
Video Editing
Digital Marketing
Advertising Campaign Management
Consultation and other creative or digital services agreed with the client.
Specific services included in a project will be defined in the relevant quotation, proposal, package, invoice, or service agreement.
2. Scope of Services
Before work begins, ArcView and the client may agree upon the project scope, deliverables, timeline, pricing, number of revisions, and other applicable requirements.
Only the services and deliverables specifically mentioned in the approved quotation, proposal, package, invoice, or agreement are included.
Any additional work, features, pages, designs, revisions, content, functionality, or services requested outside the agreed scope may be quoted and charged separately.
3. One-Time Projects and Monthly Services
A. One-Time / Project-Based Services
These services are provided for a specific project or defined set of deliverables.
The applicable quotation or proposal will specify the agreed scope, price, timeline, payment schedule, and deliverables.
B. Monthly / Retainer Services
Monthly services may include social media management, content creation, SEO, digital marketing, website maintenance, design support, or other recurring services.
Monthly packages are limited to the services and deliverables specified in the selected package or agreement.
Unused services, revisions, hours, or deliverables do not automatically carry forward to the following month unless expressly agreed in writing.
4. Quotations and Proposals
Quotations and proposals provided by ArcView are based on the information available at the time of preparation.
A quotation may include:
Project scope
Deliverables
Timeline
Number of revisions
Pricing
Payment schedule
Package details
Additional terms
A project becomes confirmed when the client accepts the proposal/quotation and, where applicable, makes the required advance payment.
Quotations may expire after the validity period stated in the quotation.
5. Payment Terms
Payment terms will be specified in the relevant quotation, proposal, invoice, or agreement.
Unless otherwise agreed:
An advance payment may be required before work begins.
Remaining payments may be due according to agreed milestones or before final delivery.
Monthly services are payable according to the agreed monthly billing schedule.
ArcView may pause work if an invoice remains unpaid.
Work may resume after outstanding payments have been cleared.
Additional services outside the agreed scope may require additional payment.
All payments are subject to the payment terms communicated to the client at the time of engagement.
6. Additional Work
Requests outside the original scope may include:
Additional pages
Additional designs
Additional concepts
Major design changes
Additional revisions
New functionality
Additional social media content
Additional platforms
Additional marketing services
Additional development work
Changes requested after approval
New requirements introduced after project commencement
Such work may be quoted separately before execution.
7. Revisions and Changes
The number of revisions included in a project or package will be specified in the applicable quotation or agreement.
A revision means a reasonable modification to the agreed design or creative direction.
A complete change of concept, direction, requirements, or previously approved work may be considered a new design or additional work.
If the client requests revisions beyond the included number, ArcView may charge an additional fee.
8. Client Responsibilities
The client is responsible for providing accurate and timely information, including where applicable:
Text and copy
Logos
Brand guidelines
Product information
Images and videos
Business information
Website content
Social media account access
Hosting or domain access
Third-party account access
Technical requirements
Feedback and approvals
The client confirms that materials supplied to ArcView do not knowingly infringe the intellectual property, privacy, publicity, or other rights of third parties.
Client delays in providing required information, content, access, approvals, or feedback may result in corresponding changes to the project timeline.
9. Project Timelines
Estimated project timelines will be communicated during the quotation or project planning process.
Timelines may depend on:
Receipt of advance payment
Receipt of required content and materials
Client feedback
Client approvals
Third-party services
Technical requirements
Changes in project scope
Where delays are caused by the client or third-party providers, ArcView will not be responsible for the resulting delay.
10. Design Approval
The client is responsible for reviewing and approving designs, content, layouts, websites, applications, and other deliverables.
Once a design or deliverable has been approved, substantial changes requested afterward may be treated as additional work.
The client should carefully review all names, spelling, prices, contact information, addresses, product information, legal notices, and other business information before final approval.
11. Website and Application Development
For website, e-commerce, and application development projects, the agreed scope will determine the features and functionality included.
Unless specifically included in writing, the following may be charged separately:
Domain registration
Hosting
Premium themes
Premium plugins
Software licenses
Third-party APIs
Payment gateway fees
Email services
SMS services
External subscriptions
Stock assets
Third-party integrations
Ongoing maintenance
Future feature development
ArcView is not responsible for failures, downtime, restrictions, policy changes, security incidents, or service interruptions caused by third-party platforms or providers.
12. Website Maintenance and Support
Website development does not automatically include unlimited ongoing maintenance.
Maintenance, updates, backups, security monitoring, content changes, technical support, and future development are included only where specifically stated in the applicable package or agreement.
13. SEO and Digital Marketing
ArcView may provide SEO, social media marketing, advertising management, content creation, campaign management, and related digital marketing services.
Digital marketing results can be affected by numerous factors outside ArcView’s control, including:
Search engine algorithms
Advertising platform algorithms
Market conditions
Competition
Audience behavior
Client website performance
Budget
Product or service demand
Third-party platform policies
Therefore, ArcView does not guarantee specific search rankings, traffic levels, leads, sales, revenue, followers, engagement, or advertising results unless a specific written guarantee has been expressly agreed.
ArcView provides professional services and agreed deliverables but cannot guarantee results controlled by external platforms or market conditions.
14. Advertising and Media Budget
Unless expressly included in writing, advertising or media spending is separate from ArcView’s service fees.
This may include advertising expenditure on platforms such as:
Meta
Facebook
Instagram
Google
LinkedIn
TikTok
YouTube
Other advertising platforms
The client remains responsible for approved advertising budgets and third-party advertising charges.
15. Social Media Services
Where social media services are included, the specific package will determine the number and type of deliverables.
These may include:
Social media posts
Reels
Stories
Captions
Hashtags
Content calendars
Account management
Scheduling
Community management
Advertising management
Only the platforms and deliverables specified in the applicable package are included.
16. Third-Party Services
ArcView may use third-party software, platforms, plugins, APIs, hosting providers, stock libraries, payment processors, advertising platforms, or other external services.
Third-party services may have their own terms, fees, limitations, and privacy policies.
ArcView cannot guarantee the continued availability, performance, pricing, compatibility, or policies of third-party services.
17. Intellectual Property
Unless otherwise agreed in writing, ArcView retains ownership of its pre-existing materials, internal processes, methodologies, templates, reusable components, tools, concepts, and resources.
Upon receipt of full payment, the client will receive the rights to the final custom deliverables specifically created and agreed for the client, subject to any third-party licensing restrictions.
Third-party fonts, stock images, plugins, templates, software, graphics, photographs, music, APIs, and other licensed materials remain subject to their respective licenses.
Unused concepts, rejected designs, drafts, working files, internal materials, and alternative concepts remain the property of ArcView unless otherwise agreed.
18. Source / Editable Files
Source or editable files are provided only when specifically included in the agreed package, quotation, or agreement.
If editable/source files are not included, ArcView may charge an additional fee for their release.
19. Client-Provided Content
The client is responsible for ensuring that all content, images, videos, logos, trademarks, text, music, documents, and other materials provided to ArcView are legally permitted for use.
The client agrees to indemnify ArcView against claims arising from materials supplied by the client where such claims result from the client’s lack of rights or authorization.
20. Portfolio and Marketing Rights
Unless otherwise agreed in writing, ArcView may display completed client work in its portfolio, website, social media accounts, presentations, case studies, and other promotional materials.
If a client requires confidentiality or does not want a project publicly displayed, this should be communicated to ArcView in writing before or during the project.
21. Confidentiality
ArcView will take reasonable measures to protect confidential business information provided by clients.
Confidential information may include business strategies, credentials, unpublished materials, financial information, customer information, proprietary documents, and other information reasonably understood to be confidential.
Confidentiality obligations do not apply to information that:
Is publicly available;
Was already lawfully known;
Becomes publicly available without breach;
Is independently developed; or
Must be disclosed by law or lawful authority.
22. Cancellation and Termination
Either party may terminate a project or ongoing service arrangement subject to the applicable agreement and any required notice period.
If a client cancels a project after work has commenced:
The client remains responsible for payment for work already completed.
Approved or incurred third-party expenses remain payable.
Completed deliverables may not be released until applicable outstanding payments are settled.
Refunds, where applicable, will be handled according to the agreed payment and refund terms.
For monthly services, the applicable cancellation notice period will be stated in the relevant agreement or package.
23. Refunds
Because creative, design, development, and marketing services involve time, resources, and customized work, payments for completed or substantially completed services may be non-refundable.
Any refund will be considered according to the applicable quotation, agreement, stage of work, and circumstances of cancellation.
Third-party costs already paid on behalf of the client may not be refundable.
24. Suspension of Services
ArcView may temporarily suspend services where:
Payments are overdue;
Required information or access has not been provided;
The client materially breaches these Terms;
The requested work involves unlawful or prohibited activity;
Continuing the engagement creates a reasonable legal, security, or operational risk.
25. Security and Credentials
Where clients provide passwords, login credentials, API keys, hosting access, or other authentication information, ArcView will use reasonable measures to protect such information.
Clients should provide access through secure methods where available and should revoke access when services are completed or terminated where appropriate.
ArcView is not responsible for security issues caused by compromised client accounts, insecure credentials, third-party platforms, or circumstances outside its reasonable control.
26. Responsibility and Third-Party Issues
ArcView will provide services professionally and according to the agreed project scope.
However, some aspects of a digital project depend on third-party services or circumstances outside ArcView’s control.
For example, ArcView will not be responsible for problems caused by:
Hosting or domain providers
Google, Meta, TikTok, LinkedIn, or other platforms
Third-party plugins or themes
Payment gateways
APIs or external software
Internet or server outages
Changes to third-party policies or algorithms
Client-provided content or information
Unauthorized changes made by the client or another third party
ArcView will make reasonable efforts to assist the client in identifying and resolving such issues where they fall within the agreed scope of services.
ArcView’s responsibility for its own services will be limited to the services and obligations specifically agreed with the client.
Nothing in these Terms limits any responsibility that cannot legally be limited under applicable law.
27. Force Majeure
ArcView will not be responsible for delays or inability to perform caused by circumstances beyond its reasonable control, including but not limited to:
Natural disasters
Internet or infrastructure failures
Major software or platform outages
Government actions
Cybersecurity incidents
Power outages
Telecommunications failures
Third-party service failures
Other unforeseen events beyond reasonable control
28. Changes to Services and Terms
ArcView may update its services, packages, pricing, processes, website content, and these Terms from time to time.
Updated Terms will become effective when published on this website unless otherwise stated.
Changes to an existing project will be governed by the terms agreed with the client for that project.
29. Governing Law
These Terms shall be interpreted in accordance with the applicable laws of Pakistan, subject to any mandatory rights or protections that may apply to clients in their respective jurisdictions.
Any disputes will first be attempted to be resolved through good-faith communication between the parties.
Where a dispute cannot be resolved amicably, the appropriate legal forum and jurisdiction will be determined in accordance with applicable law and any written agreement between the parties.
